Frank Ciano is a partner in Goldberg Segalla’s New York office and a senior member of the firm's Product Liability and Commercial Litigation Practice Groups.  He is also the leader of the firm’s Risk and Litigation Avoidance Strategies and Food and Beverage Practice Groups.

Frank specializes in the defense of complex and high-stakes product liability, commercial, corporate, regulatory, and intellectual property matters. He has defended a wide range of product liability and catastrophic injury cases, including cases involving aircraft, industrial machinery, motor vehicles, consumer products, household appliances, medical devises, food products, outdoor power equipment, gas grills and fire cases.  Frank regularly acts as national coordinating counsel for his clients.  He routinely handles cases all over the United States and assists in matters pending in Europe.

Frank is also an accomplished commercial litigator, and has successfully defended a number of “bet your company” lawsuits involving breach of contract, breach of warranty, violation of various state consumer protection statutes, construction issues and intellectual property matters.

Since attorneys’ fees, costs, expenses, delays, and the risk of an adverse decision have a direct negative impact on a company’s profitability, Frank also concentrates his practice on helping his clients avoid the risk of litigation, allowing them to remain focused on the growth and prosperity of their business.

His risk-avoidance work includes assisting his clients in preparing owners’ manuals, warnings, instructions, labels, websites, and warranties so they can more effectively convey safety information to their customers and reduce the risk of product liability claims. In addition, Frank works with his clients in the preparation of commercial agreements and contracts, and in planning all other aspects of their businesses, to minimize their exposure to commercial disputes. For example, he assists in the preparation of sales agreements, purchase agreements, distributor agreements and joint venture agreements. He serves as an editor of Goldberg Segalla’s Product Liability Playbook: Insights Into Product Liability, Risk Avoidance, and Consumer Fraud Class Actions blog.

Many of Frank’s international clients have approached him to establish their U.S. subsidiaries, so as to minimize the risk of litigation at the outset. Towards this end, Frank works with accountants and other professionals to plan the most advantageous corporate structure for the U.S. subsidiary, and plans all necessary federal, state, and local filings. He also prepares the necessary documents and inter-company agreements, such as operating agreements, to implement the clients’ business plans.

Frank frequently assists his clients with regulatory issues before agencies such as the Consumer Product Safety Commission (CPSC), Food and Drug Administration (FDA), and Environmental Protection Agency (EPA), and also works with them in avoiding regulatory fines and penalties. He has worked with clients on numerous recalls and in avoiding recalls.

Frank also assists international corporations to comply with the various requirements of the European Union Product Liability and Safety Directives. In order to better serve his clients, he works with a network of product liability attorneys in Europe, Asia, and South America.

Frank received a bachelor of engineering degree in mechanical engineering, cum laude, with a minor in computer science, from Manhattan College in 1986. Upon graduation, he worked as an aerospace engineer, designing wing and fuselage structures for air and spacecraft. He then attended Hofstra University School of Law, where he earned his juris doctor, with distinction, in 1990. In addition, he is a registered patent attorney.
