Tanguy Le Gouëllec de Schwarz is a dual-qualified lawyer (French and English law) who focuses on the resolution of insurance and reinsurance disputes, both in the UK and French courts, and on domestic and international arbitrations. 

Tanguy has acted in disputes related to product liability, financial institutions (FI), errors and omissions (E&O), and property at both the insurance and reinsurance levels. Tanguy also advises on coverage issues (both on English and French law) with respect to facultative and treaty reinsurance, product liability, E&O, FI, directors and officers (D&O), and property policies.   

Tanguy has acted in the largest reinsurance litigation in France, and on numerous reinsurance arbitrations (both facultative and treaty). Tanguy has considerable experience in asbestos-related issues at both the insurance and reinsurance levels.


Highlights of his recent experience include:
  • Acting for E&O insurers (defendants) of French brokers (producing brokers) in relation to a US $500 million litigation
  • Advising a major composite insurer in relation to a potential Part VII transfer of a portfolio of French property and casualty business, including consideration of both the English and French regimes
  • Acting for and advising aviation reinsurers on coverage issues during a French arbitration against reinsureds
  • Acting and advising insurers of a French air carrier following the crash of one of its aircraft in the Red Sea
  • Numerous coverage advices on product liability and multi-jurisdictional D&O policies
  • Acting for insurers in a faulty designed recycling truck claim
  • Advising insurers with respect to coverage issues arising out of faulty construction piles
  • Acting for insurers with respect to a severe head injury claim arising out of a faulty horsebox trailer
  • Acting for the insurers of electronic goods on numerous claims alleging faulty goods
  • Acting for a major composite insurer in arbitration (claimant) claiming historical asbestos losses under numerous reinsurance contracts
  • Acting for a captive of a large accounting firm in an arbitration against the captive’s reinsurers
  • Advising and acting for insurers and reinsurers on applicable law and jurisdiction issues in relation to reinsurance policies and acting in relation to related English Court proceedings, including in the Court of Appeal
  • Advising on and drafting a suite of commutation agreements for a major UK composite insurer in relation to long-tail business, and advising generally on the potential recoverability from reinsurers
  • Acting for E&O insurers (Defendants) of English brokers in relation to the placement of a liability insurance cover for a series of Italian hospitals
  • Advising insurers on coverage issues concerning claims issued in France by local governments against their insured bank
  • Advising Bankers Blanket Bonds facultative reinsurers of an Afghan bank on coverage issues 
  • Acting for insurers involved in a binding authority granting the coverholder (a French broker) authority to bind them for construction risks
  • Providing UK insurers with training on wordings-related issues, developments in relation to asbestos losses, and law and jurisdiction issues 

In addition, Tanguy spent 11 months on secondment to the legacy team of a major UK composite insurer, where he advised on the treatment of asbestos losses at both the direct and reinsurance levels.

Tanguy is a frequent author and presenter on topics in his areas of concentration, including reinsurance legal updates, jurisdiction issues, e-disclosure, and asbestos issues.
