We have also achieved successful results in asbestos cases on appeal. In a recent example, we won an appeal for a safety products manufacturer in a failure-to-warn claim involving a worker who died from mesothelioma. We were brought in to handle the appeal before the New York State Appellate Division, First Department, after a trial court had denied the company’s motion for summary judgment brought by previous counsel. We secured the unanimous reversal of the trial court’s denial of summary judgment, thereby dismissing the claim against the manufacturer.
