Asbestos Defense

Goldberg Segalla’s asbestos team has decades of experience in this complex and ever-evolving area of law. We serve as national coordinating, trial, and local counsel for clients in a broad spectrum of industries that have been joined in asbestos litigation — including retailers, rail operators, utility providers, contractors, commercial roofers, distributors, and manufacturers of insulation, appliances, industrial equipment, chemicals, and many other products. Our team has litigated thousands of cases over the last 30 years.

Our proactive approach, anchored in the belief that each asbestos case must be thoroughly prepared as if it were going to trial, has led to consistently successful results for our clients — whether through achieving early dismissals, developing strong medical defenses or proof regarding alternative exposure, or, when necessary, securing defense verdicts at trial.

We have also achieved successful results in asbestos cases on appeal. In a recent example, we won an appeal for a safety products manufacturer in a failure-to-warn claim involving a worker who died from mesothelioma. We were brought in to handle the appeal before the New York State Appellate Division, First Department, after a trial court had denied the company’s motion for summary judgment brought by previous counsel. We secured the unanimous reversal of the trial court’s denial of summary judgment, thereby dismissing the claim against the manufacturer.

Our attorneys publish articles and lecture regularly on asbestos topics and take pride in being nationally recognized thought leaders in the area of asbestos litigation defense. We closely monitor the growing body of case law and scientific literature, and work tirelessly to educate clients on developments in those areas, in order to provide the best and most comprehensive representation possible.
