Products Liability Practice Group

Goldberg Segalla's Products Liability Practice Group is comprised of more than 40 attorneys in ten different offices working together as a single integrated team with the sole purpose of helping our clients win or avoid product liability disputes.

Our Products Liability Practice Group is nationally recognized. Our attorneys helped write one of the leading treatises on Products Liability Law and have published dozens of articles in the journals of various national bar associations, dealing with the leading, cutting-edge issues affecting products liability litigation. We do not just belong to bar and professional associations, we are leaders who strive to maintain a visible and influential presence in relevant legal and trade organizations in order to help shape emerging issues important to our clients. Our attorneys include current and past leaders of a multitude of state and national bar associations, including the Defense Research Institute, the Products Liability Advisory Council, the International Association of Trial Lawyers, Lawyers for Civil Justice, and the Federation of Defense and Corporate Counsel.

We serve as national and regional counsel to several major product manufacturers and retailers with respect to their Products Liability claims. Our clients include some of the best known manufacturers and retailers of industrial machinery, consumer products, and pharmaceutical and medical device products. Our expertise covers a wide variety of products including industrial machinery, electrical products, consumer appliances, fire science, automotive, airplane, medical device, chemical and consumer products.

Meeting the Client’s Expectations

We are a Best Practices Firm committed to meeting the client’s goals. We are dedicated to providing top quality legal services in the most efficient and effective way to meet our clients' needs. We understand that clients have to manage litigation around the country and wish to do so in a consistent and efficient manner. We therefore make it part of our mission to comply with clients' case handling and reporting guidelines.

A Track Record of Proven Success

Our clients like to know that if they get sued their attorneys have the ability to try their case and win it. Our attorneys have tried and won products liability cases around the country for Fortune 500 clients involving claims of catastrophic injuries, multi-million dollar property losses, and health effects of pharmaceutical and medical device products. Our group is supported by a nationally recognized Appellate Practice which features former Court of Appeals and Appellate Division clerks. In the past five years, our firm was involved in myriad published opinions, including numerous cases that have helped shape Products Liability Law.

Risk Avoidance Counseling

We also understand that avoiding a lawsuit is more important than winning one. We help clients minimize and manage risks associated with making and selling products and manage the scope and application of industry and governmental standards. We counsel clients in preparing the appropriate owners' manuals, warnings and instructions regarding the proper use, and dangers of misuse, of their products. We have developed hundreds of manuals for a wide array of industrial and commercial goods. Our authorship of these materials is based on our vast experience in, and knowledge of, the multitude of ways in which plaintiffs have exposed shortcomings of less carefully drafted manuals and warnings.

We are committed to working for judicial and tort reform. We actively and proudly support these efforts through our support and membership in organizations such as Lawyers for Civil Justice, the Defense Research Institute and by preparing and submitting amicus briefs on behalf of Product Liability Advisory Counsel.

Product Recalls and Reporting

We have recognized expertise in representing product manufacturers in matters before the Consumer Products Safety Commission (CPSC), Department of Transportation (DOT) and similar regulatory agencies. We take pride in creative resolutions and productive working relationships with governmental agencies. Our Regulatory Law and Product Recalls Sub-Group attorneys stand ready to immediately address the needs of our clients in an area in which time is of the essence. Our affiliation with Studio Legale Casini, a well-respected law firm with offices in Milan and Viareggio, Italy, enables us to provide our clients with comprehensive regulatory advice applicable to both the United States and Europe.
