Workers' Compensation Litigation Practice Group

Goldberg Segalla LLP offers its clients a Workers' Compensation Litigation Practice Group, which attorneys keep abreast of even minor changes in interpretive language, used by the courts and use it to our clients' best advantage. Since every workers' compensation case is different and calls for different litigation strategies, this group participates with clients and carriers, as appropriate, to develop strategies tailor-made for each situation.

Our practice group has handled cases involving both major and minor injuries, in both the "accident" and "occupational disease" context, including:

  • Slips and falls
  • Motor vehicle accidents
  • Carpal tunnel syndrome
  • Hearing loss
  • Electrocution
  • Psychological stress
  • Cardiac events
  • Death, and many others

We are familiar with typical practice before, and procedures of, the New York Workers' Compensation Board and are prepared to handle conciliation meetings, regular hearings, testimony of claimants, employer witnesses and medical experts, stipulation settlement conferences, permanency determinations and §32 agreements.

Having good working relationships with Special Funds representatives, we have strategies in place to help ensure claims are properly "set up" for future Special Funds relief under §15-8 and §25-a.

The attorneys in this practice group have excellent working relationships with a number of experts to develop defenses to claims. We understand the priorities of self-insurers and the need to have matters resolved promptly and cost effectively, and we have significant experience in working with risk managers to find creative solutions to obstacles that impede the achievement of our clients' objectives.
