Brian T. Stapleton Interviewed in "Are Court Challenges to NY's Tough Gun Law DOA?" on North Country Public Radio March 7, 2013

Brian T. Stapleton, a partner in Goldberg Segalla’s Second Amendment Litigation and Gun-Related Issues Practice Group, was interviewed by North Country Public Radio regarding challenges to the New York Secure Ammunition and Firearms Enforcement (SAFE) Act, which was passed on January 15.

According to the segment, Queensbury, New York resident Bob Schulz, “a long time anti-government activist, who has sued government agencies repeatedly over the years,” has filed a lawsuit “aimed at making [Governor Andrew] Cuomo justify an end-run around the normal legislative process.”

However, the story detailed, legal authorities like Brian believe “that Schulz’s lawsuit is dead-on-arrival in the courts.”

Brian explained: “The court of appeals of New York state, which is New York’s highest court, has found that gubernatorial findings of necessity of the sort that supported the SAFE Act are virtually immune from judicial review, no matter how weak those letters of necessity may be.”
