Dove Burns Quoted in "Why Your Firm Should Do Psych Profiles On New Hires," Law360 April 13, 2015

Dove A. E. Burns, a partner in Goldberg Segalla’s Employment and Labor and Professional Liability Practice Groups, was recently quoted in a Law360 article on the complex issues law firms often face about psychological and personality testing for new employees.

Dove explains that while evaluating risk of potential employees, law firms can also face risks, including failure-to-hire liability.  

“Failure-to-hire claims are one of most difficult to defend because you have a lot less information on someone than, say, an employee who comes to work late and has substandard writing,” Dove said. “With an applicant you only have the resume, and — uh-oh — also a psychological test. You also know race, age and gender. Out of all that information, how do you prove it’s just about what’s on the resume?”

Dove also notes that there is a fine line between what is legal and what can violate the Americans with Disabilities Act.
