“Europeans Have Imported More Than Fast Food,” Product Liability Law in Europe, DRI In-House Defense Quarterly Winter 2007
“In the not-too-distant past, the concept of liability without fault was unheard of in Europe,” writes Goldberg Segalla partner Frank J. Ciano in this article co-authored with our European counterpart Massimo Casini. “Manufacturers doing business in Europe believed that such a drastic remedy for an injured consumer would never be accepted by any European legislative body. They were wrong.”
This article examines the European Directive on Liability for Defective Products (85/374/EEC), highlights some of its similarities to American law, and addresses a number of product liability concerns for manufacturers located anywhere in the world that do business in Europe.
