"Talc and Ovarian Cancer Litigation: A Tale of Two Extremes," DRI Toxic Torts December 2016

"To date, the FDA has not taken any action to require any talc manufacturers to warn of any potential risk associated with talc use," writes Joseph J. Welter, partner and Chair of Goldberg Segalla’s Toxic Tort and Environmental Practice Group.

Scientists have studied whether or not there’s a link between talc and ovarian cancer since the 1960s. Institutions such as the American Cancer Society and World Health Organization have both announced “mixed findings” and “limited results” as part of their studies on the potential link. As a result, courts across the country are analyzing the scientific method and literature expert witness are citing in testimony, as opposed to the studies themselves.

In his piece, Joe examines the "the strategic decisions on forum, removal and remand [that] may factor into the viability of a particular claim, coupled with the court's application of varying rules for admissibility of expert causation testimony."
