Goldberg Segalla Leads the Way Nationally On Preservation September 20, 2010

Goldberg Segalla is working to change the law – literally. Failure to preserve electronically stored information, including difficulty implementing litigation holds, has been a major concern of companies working to comply with the “e-discovery” amendments to the Federal Rules of Civil Procedure (FRCP) in 2006. Goldberg Segalla partner, John Jablonski, has been advocating for change where it matters most. John is the principle author of two papers submitted directly to the Civil Rules Advisory Committee (the group of federal judges, academics and prominent lawyers responsible for drafting amendments, new rules and the commentary appearing in the FRCP). Reshaping the Rules of Civil Procedure for the 21st Century (May 2010) and Preservation – Moving the Paradigm (Nov. 2010) were submitted directly to the Committee to present the defense view of problems and demonstrate the huge costs often associated with preservation of data. The Committee is now actively working to develop a new preservation rule. The papers were submitted on behalf of Lawyers for Civil Justice, DRI, the Federation of Defense & Corporate Counsel and the International Association of Defense Counsel.
