"Conflicts in Title Insurance: What Is the Best Approach?" ABA Title Insurance Litigation Committee Newsletter Spring 2015

“Title insurance litigators face conflicts on a regular basis,” writes Marc W. Brown, a partner in Goldberg Segalla’s Business and Commercial Practice Group who focuses on real property title claims defense and coverage matters. “These conflicts generally develop in the  context of representing an insured either under an owner’s or lender’s policy, representing the title insurance company or insured on a coverage matter, and representing the title insurance company or the title agent and/or title examiner on a recoupment action.”

In this article written for the American Bar Association Tort Trial and Insurance Practice Section’s Title Insurance Litigation Committee Newsletter, Marc explores the issue of conflict analysis — which, as he notes, “is not black or white, and each attorney or law firm has its own interpretation of ‘gray.’”

The article also previews the CLE program Marc will present July 31 at this year’s ABA TIPS Title Insurance Litigation Committee session at the ABA annual meeting in Chicago. Marc’s program will address conflicts under both New York law and the laws of other states with a significant membership in the Committee.
