New York State Supreme Court Judge Timothy J. Walker handed down a win for Goldberg Segalla and the Williamsville Central School District, dismissing a petition filed by former Assistant Superintendent for Human Resources Kim A. Kirsch, who was appealing the termination of her position following an arbitration decision issued in June 2017. Matthew C. Van Vessem, a partner in the firm’s Employment and Labor Practice Group, represented the district.
On June 12, 2017 hearing officer John T. Trela found Kirsch guilty of insubordination, misconduct, and additional charges after nearly 50 days of hearing spanning almost two years. The Williamsville Board of Education upheld the termination, and Kirsch petitioned to vacate the decision. Judge Walker’s decision has resolved the matter definitively, in favor of the Williamsville School District.
