Caroline J. Berdzik Quoted in “NJ Justices’ Public Policy View Expands 3rd-Party Liability,” Law360

Law360 turned to Goldberg Segalla’s Caroline J. Berdzik, co-chair of the Employment and Labor Practice Group, for analysis of a recent New Jersey Supreme Court ruling that employment contracts barring workers’ compensation suits against third parties are unjust, which widens personal liability injury exposure for companies that use employees.

“It is imperative that clients understand this new avenue of liability for third-party employees who get injured on the premises,” Caroline told Law360. She predicted that companies are likely to second guess decisions to contract out services like security, maintenance, and cleaning, and also to “closely scrutinize” indemnification and related contract provisions.
