Daniel E. Lust, an associate in the firm's General Liability group, examined social media privacy as it pertains to discoverability in the courtroom in an article for New York Business Journal.

"After years of overprotection, New York courts finally recognized that society knocked the top off of Pandora’s box long ago and there’s no turning back," Dan writes. "In doing so, courts held that discoverability of social media cannot and will not hinge on a user’s privacy settings. Why? Because, in today’s world, social media privacy simply does not exist."
