Goldberg Segalla Litigation Capabilities Grow With Addition of Partner Robert F. McCarthy and Associate Gary A. Marshall Jr. in Garden City April 9, 2018

The law firm Goldberg Segalla’s litigation capabilities significantly expanded with the addition of partner Robert F. McCarthy — an insurance industry veteran and former in-house senior executive at Nationwide Mutual Insurance Company— and associate Gary A. Marshall Jr. to the firm’s General Liability Practice Group in Garden City.

About Robert F. McCarthy

Bob is a trial and appellate lawyer and high-volume litigation strategist with over 25 years of experience. He has represented individual litigants, business entities, and insurers in state and federal courts, arbitrations, and declaratory judgment actions, and has tried numerous cases to verdict in matters ranging from complex contractual disputes to multimillion-dollar first- and third-party litigation. With experience in policy planning and enterprise risk management as well as oversight of litigation on a national scale, Bob maintains a particular focus on complex and high-exposure litigation involving commercial, excess and surplus, and specialty lines of insurance.

A Certified Litigation Management Professional and Fellow of the Claims and Litigation Management Alliance (CLM), Bob draws on experience and insights earned over nearly two decades in-house at Nationwide Mutual Insurance Company. He began his career in private practice providing advocacy, counsel, and coverage opinions to the Lloyd’s of London insurance market, before spending three years as an Assistant District Attorney in Bronx County, where he primarily prosecuted felony offenses and conducted numerous jury trials and investigations.

Bob started his tenure at Nationwide as a trial attorney in the company’s New York City office before taking on responsibility for regional oversight of all commercial lines litigation in New York and the Northeast. He eventually assumed national responsibility for large-loss, complex commercial and construction defect litigation strategy, quality, and customer relationships in over 50 law offices in 26 states. In this role he had oversight of several thousand lawsuits and was accountable for development, training, and maintenance of a national practice group of over 120 lawyers.

Dedicated to the insurance industry and to improving the standards and practices of the attorneys and firms who serve it, Bob is a member of the Federation of Defense and Corporate Counsel (FDCC), CLM’s Construction Claims Committee, DRI’s Workers' Compensation and Data Management and Security Committees, and the New York State Bar Association (NYSBA) Trial Lawyers Section, and was a representative for consecutive terms in NYSBA’s House of Delegates. He is also past chair of NYSBA’s 2,700-member Torts, Insurance, and Compensation Law (TICL) Section and currently serves on the Section’s Executive Committee. In 2016 he was the recipient of the NYSBA TICL John E. Leach Memorial Award for outstanding service and distinguished contributions to the legal profession. Bob earned his bachelor’s at St. John’s University and earned his J.D. at Fordham University School of Law.

About Gary A. Marshall Jr.

Gary represents clients in general litigation matters in state and federal courts throughout New York. His experience includes a wide variety of personal injury matters involving catastrophic auto accidents as well as New York State Labor Law.

Before entering private practice, Gary gained experience as a student intern in the St. John’s University Securities Arbitration Clinic, where he prepared three securities cases for FINRA arbitration, as well as in legal internships with the Hon. Peter Mayer in the Suffolk County Supreme Court and the Hon. Ira B. Warshawsky in the Nassau County Supreme Court.

Gary received his bachelor’s from the State University of New York at Geneseo and went on to earn an M.A. in English Literature from the City College of New York. He received his J.D. from St. John’s University School of Law, where he was a member of the New York International Law Review and the Dispute Resolution Society, participated in the Securities Dispute Resolution Triathlon, and received CALI Awards in the Small Business Bankruptcy, Legal Research and Writing, and Securities Arbitration Clinic categories. Active in the Nassau and Suffolk County and New York Metro legal communities, Gary is a member of the Suffolk County Bar Association and a volunteer attorney in Nassau County’s Landlord/Tenant Court.
