Class Action Against Credit Union Over Auto Transaction Dismissed
A multidisciplinary team of attorneys from Goldberg Segalla’s Business and Commercial and Global Insurance Services Practice Groups in Syracuse and Buffalo achieved summary judgment dismissal of an attempted class-action lawsuit against a credit union, saving our client from what could have been costly and potentially prolonged litigation.
The case, in which the named plaintiffs were a prominent local attorney and his son, involved allegations of deceptive business practices arising from an automobile loan transaction. On top of the class-action issues, the case required addressing a complex array of issues including collateral placement of insurance, coverage issues, insurance and banking regulations, and unfair business practice claims under the General Business Law.
Kenneth M. Alweis led the Goldberg Segalla team, with Michael Rubin taking the lead on the brief and Sarah J. Delaney providing critical assistance. The team successfully convinced the Onondaga County Supreme Court to grant our motion for summary judgment, dismissing the case against our financial institution client. The court issued its decision June 26, 2012.
