Christopher J. Belter and Daniel B. Moar secured an appellate victory before the Appellate Division Second Department in a complex commercial case. The plaintiff initially alleged only a breach of contract claim. The plaintiff later obtained leave from the trial court to amend its complaint to assert a number of additional claims, which would have exposed the client to $10 million dollars in additional potential damages. Our team obtained a unanimous reversal from the Second Department and the dismissal of all of the additional claims.
