Valve Not Defective in Product Liability Death Case

May 2, 2011
Kenneth M. Alweis

Kenneth M. Alweis and Michael Rubin recently obtained summary judgment in favor of the manufacturer of a gas control valve in a hotly contested product liability/wrongful death action.  Plaintiff was the widow of a service technician who bled to death following the explosion of a gas fireplace.  Plaintiff claimed that the valve was improperly designed and manufactured.  Our team was able to establish through extensive testing and expert evidence that the valve in the fireplace was not defective and that plaintiff’s theories and proximate cause arguments were not supported by the competent evidence.
