Michael D. Brophy, a partner in Goldberg Segalla’s Professional Liability Practice Group, is the longtime author and editor of Medical Malpractice Depositions, a textbook that outlines the planning, tactical, and strategic approach of effectively and efficiently gathering, eliciting, preserving, and presenting testimony from potential witnesses. The widely used book, first published in 2004 and available in loose-leaf and electronic format, provides both actual work product and analysis of the deposition process in medical malpractice litigation.

The 2013 edition of the book features “Concussion and Traumatic Brain Injury Litigation,” a new chapter co-authored by Mike with Joseph M. Hanna and Robert M. Cook, partners in Goldberg Segalla’s Sports and Entertainment and Product Liability Practice Groups. The chapter examines the nature, definition, and scope of concussions, and it provides practical insight into concussion and chronic traumatic encephalopathy (CTE) litigation in light of the increase in awareness of sports and other types of head injuries.
