“The vast majority of states have consumer protection laws, and over the last several decades in particular, courts across the country have debated whether such laws should apply to licensed professionals,” writes Matthew S. Marrone, a partner in Goldberg Segalla’s Professional Liability Practice Group. “Although the cases throughout the country are quite similar in nature, judges considering these similar issues have created a complex web of conflicting decisions based on highly subjective and speculative parameters.”
