“Late last month on its website, the Pennsylvania Department of Health, which is responsible for regulating long-term care facilities, asserted that statements of deficiencies and plans of correction are not evidence of compliance with the legal standard of care or an admission of wrongdoing on the part of a facility in a private lawsuit,” writes Caroline J. Berdzik, Chair of Goldberg Segalla’s Health Care Practice Group.
“This announcement provides both clarity and some welcome relief for facilities that are fighting an uphill battle against an increasing number of nursing home malpractice claims.”
