Caroline Berdzik Joins Marsh McLennan’s Risk Insights: Senior Living & LTC Podcast
Caroline Berdzik, partner and chair of the firm’s Employment and Labor, Health Care, and Long-Term Care groups, joined Marsh McLennan for their Risk Insights: Senior Living & LTC Podcast. In her episode, “Understanding the Evolving Employment Legal Landscape” Caroline delved into emerging areas of exposure facing senior living and long-term care facilities, such as the challenges with independent contractors and whistleblower claims, and also shared tips to mitigate risk in these high-exposure areas.
“These federal agencies have entered in too, which is somewhat of a new phenomenon,” said Caroline as she explained that federal agencies have started to share information with each other as they enhance efforts to coordinate during investigations. Citing an example, she explained further that the Department of Labor is now able refer a complaint to other federal agencies and allow them to advise your employees.
Furthermore, Caroline underscored the potential liabilities associated with utilizing staffing agencies who may engage in unlawful practices. She explained, “You are considered to be a joint employer because you are directing the day-to-day activities of the staff,” emphasizing the importance for providers to exercise caution and fully comprehend their obligations in such scenarios.
