Cheryl Possenti Quoted in “4 Things You Should Know About Product Recalls,” IndustryWeek
Cheryl A. Possenti, a partner in Goldberg Segalla’s Product Liability Practice Group, was recently quoted in an IndustryWeek article offering guidance on how manufacturers can deal with product recalls to avoid ensuing fines and litigation.
“The manner in which a safety issue is reported to the government and the manner in which a recall is conducted can have a profound effect on subsequent litigation, including class actions,” Cheryl said, noting manufacturers should provide an adequate remedy to a recall. “The teaching point is you might think you are going to be paying less or expending less effort in the recall but it might buy an opportunity for somebody to make claims later in a class action.”
Cheryl also talks about the importance of following precise rules to avoid harsh penalties when reporting a recall with organizations such as the U.S. Consumer Product Safety Commission.
