Jeffrey L. Kingsley Quoted in “Policyholders See Golden Ticket in Syracuse Subpoena Ruling,” Law360

Jeffrey L. Kingsley, a partner in Goldberg Segalla’s Global Insurance Services Practice Group, was interviewed by Law360 on the decision by the New York Appellate Division, Fourth Department, to uphold a lower court ruling granting coverage to Syracuse University for  responding to grand jury subpoenas in state and federal investigations over alleged sexual abuse by former basketball coach Bernie Fine.

“This may empower insureds to seek coverage for more subpoenas, even if they’re not direct targets,” Jeff told Law360. “Insurers are going to argue that the scope is too broad, it’s too speculative.”

Insurers may take a closer look at language they can inject into their policies to limit coverage or they may adjust premiums to address the risks, Jeff said, but added that the law is not completely settled because the context the subpoenas are issued in will matter.
