Jonathan S. Ziss Quoted in “Asiana Crash Reminds Insurers of Potential for Worse Aviation Losses,” BestWeek

Jonathan S. Ziss, Chair of Goldberg Segalla’s Aviation Litigation Practice Group, was interviewed by BestWeek for an article examining the insurance impact of the July 7 Asiana Airlines Flight 214 crash in San Francisco.

Jonathan noted that liability claims are likely to be limited by the Montreal Convention, an international treaty under which air carriers have strict liability for proven damages up to about $170,000. “Above that, the airline can defend itself,” Jonathan told the A.M. Best publication. “It’s not likely that the liability losses arising from this claim will be enough to move the needle on the markets … the markets are well positioned to absorb a loss even as catastrophic as this.”
