Michael Hamilton Discusses Human Trafficking Coverage Disputes Amid World Cup
As the 2026 FIFA World Cup and other large international events create opportunities for human trafficking, Goldberg Segalla partner Michael A. Hamilton was quoted in Law360 on the complex insurance disputes surrounding related claims.
The article, “World Cup Spotlights Human Trafficking Coverage Disputes,” examines whether businesses are entitled to commercial general liability coverage when accused of benefiting from trafficking. Recent court decisions have generally favored policyholders, with some rulings finding that insurers must at least defend businesses against trafficking-related claims when negligence is alleged.
Mike, who leads the firm’s Global Insurance Services team in Pennsylvania, notes that the U.S. Department of the Treasury’s Financial Crimes Enforcement Network (FinCEN) issued a May notice outlining red flags for human trafficking activity ahead of the World Cup. He explains that such guidance could play a role in future coverage disputes, particularly when insurers argue that policyholders should have been aware of trafficking risks.
“Some of the allegations really go towards knowing intentional conduct by an insured, so that could implicate whether there is an occurrence under the insuring agreement of the policy,” Hamilton says. “In addition to that, there are exclusions that inevitably come to light with respect to these claims, such as a criminal acts exclusion or an expected or intended exclusion.”
He added that he expects continued growth in coverage litigation as trafficking-related claims increase nationwide.
