Michael Hamilton Co‑Authors Article on Insurance Coverage for Sexual Misconduct and Abuse Claims
Goldberg Segalla partner Michael Hamilton co‑authored “What Is the Availability of Insurance Coverage for Claims of Sexual Misconduct and Abuse?” published in the University of Connecticut School of Law’s Insurance Law Review. The article appears in a special issue that serves as the inaugural Journal of the American College of Coverage Counsel (ACCC).
In the article, Mike examines the availability and limitations of coverage for claims alleging sexual misconduct and abuse, providing a detailed overview of how these claims typically arise, how they are pleaded, and how coverage disputes develop across different policy forms and jurisdictions. Drawing on his extensive experience advising insurers and litigating high‑exposure coverage disputes, he addresses the evolution of sexual misconduct and abuse exclusions, the treatment of intentional acts and “occurrence” requirements, allocation issues where covered and uncovered claims or insureds are intertwined, and the growing influence of public policy and recent case law on coverage determinations.
Also a member of the ACCC’s Board of Regents and its Executive Committee, this article further underscores Mike’s status as a thought leader in the insurance coverage community.
