Goldberg Segalla partner Daniel S. Strick co-authored “Avoiding the Pitfalls of Generative AI” for The Brief, a quarterly publication of the American Bar Association’s Tort Trial and Insurance Practice Section (TIPS).

A partner in the firm’s Management and Professional Liability practice group in Philadelphia, Dan examines the growing role of generative AI in the legal profession, highlighting both its benefits and its risks. The article explains that, unlike traditional AI, generative AI creates new content by identifying patterns in existing data, making it a powerful tool for tasks such as drafting documents, summarizing information, and conducting preliminary research. While these capabilities can improve efficiency and client service, Dan emphasizes that generative AI is not a source of truth and that attorneys must independently verify AI-generated content for accuracy.

The article also reviews emerging guidance from courts, bar associations, and the American Bar Association regarding the ethical use of AI. Although many jurisdictions permit the use of generative AI, lawyers remain responsible for maintaining competence, protecting client confidentiality, verifying citations and factual assertions, exercising independent judgment, and supervising AI-assisted work. Dan concludes that generative AI can be a valuable tool for legal professionals, but only when paired with human oversight and accountability.
