Goldberg Segalla Business and Commercial Team Wins Dismissal of Bad Faith and Negligence Lawsuit against Major Online Retailer
A strategic defense waged by the Goldberg Segalla Business and Commercial practice group team secured the dismissal of all claims against a multinational technology and e-commerce company represented by our firm, including bad faith and negligence.
The lawsuit was filed in New Jersey Superior Court, Gloucester County, where our client was accused of negligence, negligent hiring and property damage by the plaintiff, who also averred a bad faith claim against our client as well.
Defending the case was GS partner and Business and Commercial practice group co-chair John M. McConnell, along with partner Courtney E. Darmofal and attorney Cameron L. McIver.
Our team filed a motion to dismiss the bad faith claims, arguing the conduct of our client and its employees did not rise to the level of bad faith under New Jersey law, noting in particular that our client had no legal duty as a matter of law to the Plaintiff with respect to Plaintiff’s claims.
We also moved to dismiss the negligent hiring, negligence, and property damage claims as a matter of law, asserting that the conduct of our client and its employees did not state a cognizable claim under New Jersey law.
The motion was granted by the court, which dismissed all claims against our client with prejudice.
