Experience
Jonathan L. Berkowitz is the vice-chair of our Health Care and Long-Term Care practices. He focuses his practice on representing nursing homes, assisted living facilities, acute psychiatric health hospitals, home health care agencies, substance abuse rehabilitation providers, medical transportation providers, and day- and child-care facilities in matters involving management and professional liability.
Jon approaches each matter as a collaborative partnership with his clients and an opportunity to not only mitigate risk and exposure in existing matters, but also to optimize future patient care. He regularly uses innovative, peer-reviewed medical research to develop creative legal theories in defense of his cases. A zealous client advocate, Jon has achieved positive results in a number of catastrophic, high-exposure matters.
Prior to pursuing his juris doctor from Hofstra University’s School of Law, Jon earned his bachelor’s in journalism from the University of Florida.

- Successfully moved for summary judgment on behalf of an outpatient substance abuse counselor in a wrongful death action involving an anesthesiology resident who committed suicide by administering a lethal overdose of Propofol
- Represented a nursing home in a case regarding a resident with severe multiple sclerosis who sustained second- and third-degree burns caused by a coffee spill incident
- Defended a nursing home in an action regarding a resident who sustained a traumatic brain injury following a fall from bed with an ensuing pressure injury, required feeding tube, mechanical ventilation, and death
- Represented an acute psychiatric hospital in a wrongful death matter pertaining to two temporary aides who were videotaped and subsequently criminally charged for failing to assist a fallen patient
- Defended a licensed home care agency in a case regarding a client who sustained a fractured hip, pressure injuries, and an above-the-knee amputation after a fall
- Represented an assisted living facility that allegedly failed to prevent a resident with dementia from choking to death
- Represented a transportation company that allegedly left an intellectually disabled, group habilitation program participant alone on a bus for approximately five hours
- Resolved a pedestrian-knockdown case involving a plaintiff who suffered a severe traumatic brain injury resulting in the loss of speech, confinement to a wheelchair, and multiple surgical procedures
- Procured dismissal of a catastrophic injury claim involving a pedestrian who was crushed by a collapsing parapet wall
