Congratulations to Goldberg Segalla partners Colleen E. Hayes and Sean P. Hvisdas, along with attorney Andrew J. Simmers, on their recent victory on behalf of a mutual insurance company in Pennsylvania.

In this matter, an insurance company, both in its own capacity and as the subrogee and assignee of its insured, sued our client for breach of contract and bad faith arising from its handling and defense of an underlying personal injury action. Although the case involved a dispute between insurers, the litigation was highly contentious from the outset.

Our team responded by filing preliminary objections to the complaint, arguing that the plaintiff lacked standing to assert its claims and failed to plead sufficient facts to support its allegations. The trial court agreed, sustaining the preliminary objections and dismissing the 40-page complaint with prejudice.
