Thomas F. Segalla, Michael T. Glascott, Ashlyn M. Capote, and Brandon D. Zeller examined courts’ analyses in insurance coverage cases arising out of construction defect claims in Part I of “Construction Defect Claims: A 2018 Update” for Mealey’s Litigation Report.
The report covers cases in 17 different U.S. states. “One thing that these cases have in common is that they tend to be extremely fact-specific,” the authors write, “and although there is no ‘one size fits all’ rule to determine how courts will decide these issues, there are some key characteristics that can inform the construction industry.”
