Goldberg Segalla Attorneys Serve as Contributing Authors to NYSBA’s Construction Site Personal Injury Litigation
Ten members of Goldberg Segalla’s Construction Litigation and Counsel practice group were heavily involved in writing and editing the Fourth Edition of Construction Site Personal Injury Litigation – a comprehensive legal treatise published by the New York State Bar Association (NYSBA).
The treatise serves as an authoritative guide and indispensable resource for attorneys handling construction-related personal injury cases in New York, especially those involving the state’s Labor Law §§ 200, 240(1), and 241(6). Construction Site Personal Injury Litigation is particularly specialized, as New York is the only remaining state that still upholds these specific construction statutes.
The First and Second Editions of Construction Site Personal Injury Litigation were primarily authored by Goldberg Segalla founding partner Thomas F. Segalla. For the Third Edition, Theodore W. Ucinski—vice chair of the firm’s Construction Litigation and Counsel practice group—and Kelly A. McGee contributed significantly to the writing and editing process. Ucinski, McGee, and Segalla are all credited as Editors in Chief of the Fourth Edition.
The following Goldberg Segalla attorneys collaborated to co-author significant chapters of the treatise:
Ch. 2 – Construction Accident Investigation (Kenneth M. Alweis)
Ch. 3 – Labor Law § 200 Causes of Action and Defenses (Frank G. DiSpirito and Andrew N. Fluger)
Ch. 5 – Overview and Developments Concerning Labor Law § 241(6) (William T. O’Connell and Emily S. Schierhorst)
Ch. 6 – Insurance Coverage and Indemnity Unveiled (Sarah J. Delaney and Zachary D. Oliva)
Ch. 8 – Legislative History of the Labor Law (Alweis)
Ch. 9 – Key Case Developments (Ucinski, McGee, and Segalla)
A message about the publication from the preface:
“Since our last edition, the Court of Appeals has issued no less than six decisions interpreting the Labor Law. In this edition, our authors have updated traditional concepts and analyzed the changes in interpretation that have occurred as a result of those decisions and other Appellate Division decisions. In light of the quickly changing landscape of our profession, our authors have offered some practical suggestions that will help in the analysis and litigation of these cases.”
The Fourth Edition covers topics such as:
- Pleading and proving the necessary elements of a cause of action;
- OSHA inspections and enforcement actions;
- Construction accident investigation and handling discovery;
- Insured coverage issues and indemnification;
- Recent key appellate case summaries to give the reader an overview of and update on the pertinent issues and their continual evolution;
- View from the bench – a judge’s perspective on the Labor Law;
- Legislative history of the Labor Law.
Goldberg Segalla attorneys are well-respected legal authors, with an extensive list of national and international publication credits. Our Construction team collaborates to author a biannual Labor Law Update to keep clients informed of significant developments and case law involving New York’s Labor Law. In addition, Ucinski and McGee host two corresponding webinars each year, offering a live forum to discuss recent labor law developments.
